Shooting Victims at Trump Rally Sue Federal Government for Negligence

James Copenhaver and David Dutch, both injured during a shooting at a Pennsylvania rally for Donald Trump, have filed lawsuits against the federal government. They cite negligence by the U.S. Secret Service and the Department of Homeland Security (DHS) in failing to secure the event at the Butler Farm Show grounds.

Details of the Lawsuit

The lawsuits, filed in the Western District of Pennsylvania, name the United States government as the defendant. They specifically highlight the use of the AGR Complex roof by the shooter, Thomas Crooks. The plaintiffs argue that security was inadequate, allowing the attack to occur.

The Secret Service’s failures led directly to the shooting, with a Senate investigation finding a “cascade of preventable failures.”

Both men and their wives are part of the legal action. Dutch was shot in the abdomen and required several surgeries. Copenhaver was hit in the abdomen and left arm, with bullet fragments still lodged in his body.

Security Lapses Cited

During the rally on July 13, 2024, Crooks nearly hit Trump before a Secret Service sniper killed him. The legal complaints emphasize the failure to secure the roof, despite warnings.

Additionally, Corey Comperatore, a former volunteer fire chief, died protecting his family. The lawsuits describe the Secret Service’s ineffective communication and fragmented command structure as contributing factors.

Secret Service Response

The lawsuits argue that the Secret Service had already acknowledged deficiencies, citing communication breakdowns and human errors that facilitated the shooting. Multiple agents faced suspension or reassignment as a result.

Authorities had noted Crooks’ erratic behavior and use of a range finder prior to the attack. Still, they failed to act effectively.

The plaintiffs seek $150,000 in damages, along with interest and legal fees. Efforts to obtain comments from the White House, Secret Service, and DHS have been made by Fox News.
