Justice Department Challenges Ohio Court Rule on Immigration Arrests

The Justice Department filed a lawsuit against an Ohio court on Tuesday. The issue is a new rule that prevents federal immigration arrests at or near the courthouse. The Department accuses local officials of impeding federal enforcement, pushing ICE agents to make arrests in riskier locations.

The rule in question comes from the Franklin County Municipal Court. It prohibits civil arrests at the courthouse unless officers present a judicial warrant. The Department of Justice argues this rule clashes with federal immigration law. Federal law allows ICE agents, in certain situations, to make arrests with administrative warrants or no warrant at all.

This type of rule obstructs federal law enforcement and facilitates evasion of federal law by dangerous criminal aliens, despite Congress’s direction that federal agents detain and remove them, stated Assistant Attorney General Brett A. Shumate of the Justice Department’s Civil Division.

He further mentioned that federal agents have routinely and safely conducted arrests, not only across the country but also in this specific courthouse. The Department of Justice seeks to protect this significant federal authority.
