A California couple is embroiled in a legal dispute with their surrogate over parental rights to their newborn son, who has a life-threatening heart defect. The child’s condition has deteriorated, and the parents, Nausheen Gilkar and Omar Ahmed, expressed their anguish in a Texas court, stating their determination to retain custody despite prior considerations of abortion.
Surrogacy Dispute Intensifies
Nausheen Gilkar took the stand, tearfully reaffirming their claim to the child amidst allegations that the surrogate, McKenna West, seeks custody due to instability. The case has gained attention from right-to-life groups and political figures, as West turned to GOP officeholders for support.
Gilkar and Ahmed named their son Rumi, while West referred to him as Gabriel. West seeks sole conservatorship for medical decisions. The court has not yet issued a final order.

Surrogate’s Perspective
West testified about past intentions to terminate the pregnancy at the couple’s request. At 23 weeks pregnant, she felt uncomfortable with the decision due to her belief in the child’s potential to survive and thrive.
Following Rumi’s birth, the couple obtained a restraining order against West, barring her from contact with the newborn. The judge maintained the restraining order but did not determine custody.
Child’s Health Concerns
Court documents revealed that Rumi is critically ill, exhibiting complications from post-birth procedures. Diagnosed with hypoplastic left heart syndrome, fewer than 1,000 newborns face this condition yearly, characterized by underdevelopment of the heart’s left side.
Gilkar described Rumi’s struggle during surgery and his need for a blood transfusion. She passionately described him as the most beautiful person I’ve never seen,
highlighting the parents’ love amidst his suffering.
Legal Accusations
Attorneys representing West have accused Gilkar and Ahmed of considering an abortion, questioning their commitment to Rumi’s medical care. West’s legal team argued that she should have conservatorship, as they believe the couple intended to end the pregnancy.
Attorney Jeff Domen interrogated Gilkar about their decision to terminate the pregnancy. She acknowledged the request, denying regret and struggling with questions about trust and care for their child.
Surrogacy Contract Violations
Gilkar and Ahmed assert that West violated the surrogacy agreement. Gilkar described her challenging journey with in vitro fertilization, explaining her choice to pursue surrogacy due to medical necessity following a hysterectomy.
West lived with them during the IVF transfer, and Gilkar recounted the emotional experience of supporting West during the procedure.
While a California court found West has no custodial rights, she seeks to overturn this decision in Texas, vowing to fight for custody following the child’s diagnosis.
Surrogacy laws vary by state, lacking federal regulation and allowing for diverse interpretations. Domen declared, We believe Ms. West is the mother of this child.
