Kalshi, a prediction market platform, has permanently banned former Congressman George Santos following allegations of insider trading tied to President Trump’s State of the Union address. The company imposed a $71,356 fine on Santos for misleading the public and profiting from his deception.
According to NPR, authorities investigated Santos for trades related to the Kalshi market concerning attendance at the State of the Union. Santos posted a misleading video on X, claiming he would attend, while he had already placed a bet that he wouldn’t show up. Kalshi reported Santos made over $17,000 in profit from this bet.
The Commodity Futures Trading Commission (CFTC) ordered Santos to return his profits and fined him $17,500 as part of a settlement. Santos, previously expelled from Congress in 2023 for fabricating details about his career, was also guilty of federal wire fraud and identity theft. President Trump later commuted his seven-year prison sentence.
Politicians have also faced disciplinary actions on Kalshi. Laurie Buckhout, a Republican candidate from North Carolina, was fined and suspended for betting on her own campaign. Stephen Cloobeck, who attempted a gubernatorial bid in California, received similar penalties. Ben Midgley, another candidate for governor in Maine, faced a three-year suspension after betting on his candidacy.
Kalshi’s regulatory issues continue as federal and state bodies debate whether prediction markets should be classified as gambling. The CFTC has taken a legal stance against states treating these platforms as gambling sites. The U.S. Court of Appeals for the 9th Circuit ruled Nevada had the right to ban Kalshi as an illegal gambling operation, contradicting an earlier ruling from the 3rd Circuit Court.
Last month, 44 states urged the Trump administration to treat prediction market operators as gambling entities, citing potential harm to young people and those with gambling addictions. The Supreme Court may ultimately decide the legal framework governing prediction markets.
