A NASCAR driver faced the financial repercussions of North Carolina’s longstanding ‘Homewrecker Law,’ which allows for lawsuits over extramarital affairs. In recent events, Truck Series driver Jennifer Jo Cobb, aged 53, was ordered by a court to pay $850,000. The ruling came after she was accused of alienating the affections of longtime NASCAR spotter Clayton Hughes.
The lawsuit originated from Hughes’ former wife, Stacey Hughes. She accused Cobb of deliberately enticing her husband back in 2021, prior to their divorce. The court based its decision on evidence provided by Jim Rorie, a private investigator hired by Stacey Hughes. The investigator testified that he overheard Cobb and Hughes during an intimate encounter at a hotel in October 2020. His account included explicit details about the occurrences, which contributed to the judge’s ruling.
Adultery may be viewed as morally unacceptable across the United States, but in North Carolina, it’s also a legal issue. The state permits lawsuits for ‘alienation of affection,’ which involves intentionally disrupting a marriage. Additionally, the judge ordered Cobb to pay $50,000 specifically for this claim.
Cobb also faced a separate claim of ‘criminal conversation,’ resulting in an $800,000 penalty. This legal term refers to a civil lawsuit against a third party for engaging in sexual relations with a married individual while the marriage remains legally binding.
Cobb’s racing career spans 31 NASCAR O’Reilly Series starts and 234 Truck Series races. Her notable finish was sixth place at Daytona in 2011. Despite her achievements in racing, the legal battle serves as a reminder of the potential personal consequences of extramarital relationships under North Carolina law.
