Florida Man Executed and Mississippi’s New Death Penalty Law

James Duckett was executed for the 1987 rape and murder of Tereasa McAbee, an 11-year-old child. There is evidence suggesting his involvement in another crime that same year, involving Jeanifer Weldon.

A new Mississippi law, effective July 1, has expanded criteria for the death penalty, including the sexual battery of a child under 12. Senate Bill 2821 introduces the crime of ‘capital sexual battery.’ This law enables prosecutors to seek the death penalty against those aged 18 or older in cases with victims younger than 12.

A jury must find at least two specific aggravating factors beyond a reasonable doubt for a defendant to be eligible for the death penalty. At least 8 out of the 12 jurors must recommend the death penalty. Without this recommendation, the mandatory sentence is life without parole.

State Senator Jeremy England, who authored the bill, argued the legislation aims to impose the severest punishments for crimes against vulnerable populations. He noted that such crimes shock the conscience, considering them the most vile against innocent citizens in Mississippi.

However, there are criticisms of the law, questioning if it deters crimes against young victims or may deter children from reporting abuse, fearing the potential consequence of death for the accused. This law change extends the potential applications of capital punishment beyond just murder charges.

Abraham Bonowitz, director of Death Penalty Action, once a supporter of capital punishment, voiced his opposition to executions. He argues life sentences suffice to keep inmates permanently incarcerated without needing executions.

Bonowitz further cautioned that if the death penalty applies to child sexual assault cases, victims might become reluctant to report the abuse, particularly when it involves known individuals, like relatives, to avoid leading to an execution.
