Georgia Congressman Seeks Investigation into H-1B Visa Fraud Allegations

Rep. Rich McCormick, a Republican from Georgia, is requesting an investigation into alleged misuse of the H-1B work visa program in his district. This area, which includes parts of Atlanta’s suburbs, is suspected to be a center for visa fraud.

McCormick sent a letter to the Trump administration, expressing concerns about potential abuses in his district, which might impact local wages and labor competition. He offered to assist with any cooperation needed between state agencies and law enforcement.

The H-1B program allows American businesses to hire foreign workers temporarily for high-skill positions. It was created by the Immigration Act of 1990. However, McCormick argues the program is now plagued by fraud. Abuses include hiring workers at below-market wages, benefiting “bad actors” who exploit conditions requiring visa holders to stay employed to avoid deportation.

“Unfortunately, the H-1B program has become the subject of rampant fraud and abuse for the nefarious purposes of obtaining labor that bad actors can exploit below-market-rate wages and abusive work conditions given H-1B holders’ dependence on retaining their employment in order to avoid removal back to their country of origin,” McCormick wrote.

The congressman pointed out that his concerns stem from stakeholder engagement, constituent reports, and recent federal investigations. Although no specific businesses were named, McCormick noted Atlanta’s economic growth and its busy international airport make it a target for fraudulent activities.

The Trump administration already started investigating potential H-1B visa fraud in July. Discussions around H-1B visas are heated. Critics, like Vice President JD Vance, consider it a flawed system and call for its abolition. Supporters argue that the visas are essential for attracting international talent, especially in technology and engineering.
