A judge has dismissed the murder charge against Aaron Spencer, the Republican nominee for Lonoke County sheriff in Arkansas. The decision was based on missing evidence and misconduct by law enforcement officials.
Aaron Spencer faced accusations of shooting Michael Fosler. Fosler was charged with sexually assaulting Spencer’s 13-year-old daughter. The judge cited the loss of key dashboard camera footage as a violation of Spencer’s due process rights.
The Court finds that conduct by law enforcement was so egregious that dismissal of this case is warranted.
According to court documents, Spencer admitted to shooting Fosler. The incident occurred after Spencer found his missing daughter with Fosler in a car. At the time, Fosler was out on bond for the assault charges.
Spencer claimed he acted to protect his daughter, stating Fosler restrained her in the car. The state prosecutors argued that Spencer had planned the killing and should have contacted the police.
