Attorneys for Mangione, led by Karen Friedman Agnifilo, argue that the media access rules for the trial infringe on Mangione’s constitutional right to a public trial. In a recent court filing, Agnifilo questioned the constitutionality of restricting the trial to 68 journalists, fearing undue influence over which reporters attend.

Agnifilo raised three key concerns:

• The court’s decision not to use an available overflow courtroom.
• Selection of reporters by the court and district attorney.
• Lack of opportunity for input on these decisions.

Further exacerbating these concerns, the defense was not consulted on media access guidelines and only learned of them from an independent journalist.

Request for Public Hearing

Agnifilo seeks a public hearing and detailed explanations from the court about the selections made. She also requests a list of six journalists chosen for the jury selection coverage and details of criteria used to grant permissions to the rest.

Without an overflow room, Mangione’s attorneys call for proceedings to be broadcast live to ensure transparency.

Trial Schedule

Mangione appears in court for an evidence suppression hearing, with his federal trial scheduled for January. Defense concerns stress the need for openness and fairness in court proceedings.
