In May 2024, Andrea Lucas, a commissioner with the Equal Employment Opportunity Commission (E.E.O.C.), composed a 26-page memo. She accused Nike of consistently discriminating against white employees and applicants. Lucas highlighted that Nike’s internal diversity targets might have led to unlawful hiring practices, implying that race determined employment decisions including training programs.

“If any of Nike’s employment decisions have been influenced by race,” Lucas asserted, “the company has violated federal law.”

Lucas’s memo expedited a civil-rights investigation into Nike. Her appointment by President Trump further fueled the investigation as she advanced within the E.E.O.C. to become its chair.

The E.E.O.C. has historically investigated discrimination in hiring and promotions based on race, sex, disability, or national origin. The agency has also bolstered efforts by employers striving to diversify their workforce pools.
