Special Prosecutor Appointed Following Law Enforcement Misconduct

Porter County Prosecutor Gary Germann has ordered a special prosecutor to investigate the improper use of the Flock camera system by a sheriff’s deputy. The deputy misused the License Plate Reader System three times. Initially, Germann announced that the deputy would not face criminal charges, but he has since reconsidered.

“While we can all agree that law enforcement’s actions in this case were improper, I now believe the issue of whether those improper actions rise to the level of criminal conduct should be evaluated by another prosecutor,” Germann stated in his remarks.

The Flock License Plate Reader system is under scrutiny over privacy concerns, following other incidents, such as a resignation in Chesterton Police due to misuse. Portage Mayor Austin Bonta indicated discussions on the city’s contract with Flock and police policy regarding the system are upcoming.

Public Reaction and Transparency Efforts

Germann has faced public dissatisfaction regarding his initial decision, prompting his reversal. To reassure the community, Germann emphasized that bringing in a special prosecutor is not influenced by connections between his office and the Sheriff’s Department. Jacob Taulman, Jasper County prosecutor, is set to investigate the case.

In an Aug. 28 statement, Sheriff Jeff Balon revealed disciplinary actions against an officer for inappropriately using the Flock system. The officer received demotion, suspension without pay, and ethics training. Balon confirmed that no crime was committed but acknowledged policy violations.

Germann highlighted a distinction from a Jackson County case, where a deputy reportedly used the Flock system over 2,000 times fraudulently. An internal affairs investigation confirmed improper database access by an officer in Porter County, triggering Balon’s decision to strengthen protocols.

Enhanced Policy and Oversight

Balon noted that initial misconduct predated recent policy enhancements. The sheriff’s department now requires a case number and a reason for every Flock system search. The addition of Flock’s Audit system provides advanced oversight through Artificial Intelligence, flagging suspicious searches for review.

Such measures aim to fortify accountability and public trust in law enforcement practices regarding technology use.
