Representative Nancy Mace has sparked controversy by advocating for the public execution of Lindsay Clancy. This statement comes just days after a Massachusetts jury failed to reach a verdict on Clancy’s criminal responsibility for the deaths of her three children.
The South Carolina Republican expressed her views on Monday to TMZ, saying, “Her children are dead, she should be dead too. She should get the death penalty… It should be public, it should be a public execution.”
Mace’s suggestion cannot be implemented in Massachusetts. The state last executed someone in 1947. Additionally, its highest court invalidated the state’s capital punishment law in 1984. If Clancy is convicted of first-degree murder, she could face life imprisonment without the possibility of parole.
This call for execution follows the recent declaration of a mistrial in Clancy’s case. Earlier this month, the judge presiding over her murder trial declared a mistrial after the jury reported being unable to reach a unanimous decision.
Clancy, age 36, has admitted to killing her children—Cora, aged 5, Dawson, aged 3, and Callan, aged 8 months—in January 2023. However, she has pleaded not guilty. Her legal defense argues that she was experiencing severe postpartum psychosis at the time of these deaths and her subsequent suicide attempt. The possibility of a retrial remains, although prosecutors have yet to announce any definitive plans.
Mace is not alone in her demands. Following the mistrial, Georgia Republican Representative Clay Fuller also called for capital punishment, stating that individuals who “brutally murder” children “deserve the death penalty.” He further advocated for federal restrictions on the insanity defense.
This situation is evolving, with further updates expected as new information becomes available.
