Virginia Prosecutors Refuse to Enforce Gun Ban

Ryan Mehaffey, a Marine veteran and prosecutor in Virginia, is taking a firm stand against a new gun ban signed by Governor Abigail Spanberger. He believes the law, which restricts the sale and manufacture of certain firearms, is unconstitutional.

Gun Ban Details

Governor Spanberger’s bill bans the future sale of ‘assault weapons,’ including various semiautomatic rifles, pistols, and shotguns. Magazines with a capacity of over 15 rounds are also prohibited. This law sparked opposition among Virginians and raised concerns of Second Amendment violations.

Prosecutors Push Back

Mehaffey, who serves as the Spotsylvania County Commonwealth Attorney, refuses to enforce the measure. He wrote to the local Sheriff, calling the ban unlawful. He argues that the Second Amendment is meant to protect a community’s ability to defend itself with a well-regulated militia, citing historical precedents and legal traditions that support citizen firearm ownership for public defense.

Phillip Blevins, the Commonwealth’s Attorney for Smyth County, also refuses to enforce the bill. He insists his stance is based on constitutional obligations rather than political motivations. Blevins highlights his commitment to supporting and defending the U.S. and Virginia Constitutions.

Legal Challenges

Aside from the prosecutors’ opposition, gun-rights groups like the NRA and Firearms Policy Coalition have launched lawsuits against the ban, arguing it infringes on constitutional rights. Mehaffey believes that ultimately, the Second Amendment will supersede any contradictions introduced by the state legislation.

Governor’s Perspective and Response

Governor Spanberger’s office defends the gun ban as a necessary measure to protect families, communities, and law enforcement. Spanberger expressed her intent to work on clarifying the legislation to distinguish firearms often used for hunting.

Mehaffey emphasizes his dedication to his role and to safeguarding citizens’ rights. He calls for government officials to adhere to constitutional duties and to serve the people faithfully.
