Judge Blocks Justice Department from Accessing Transgender Youth Medical Records

A federal judge in Manhattan ordered the Justice Department to halt its efforts to obtain sensitive medical information about transgender youth who received gender transition care at New York City hospitals. The ruling was made on Wednesday by Judge Katherine Polk Failla of the Federal District Court.

The Justice Department, under the Trump administration, had been investigating medical providers offering gender transition treatments to adolescents. They claimed these treatments were harmful to impressionable and vulnerable children. For more than a year, hospitals and medical professionals in New York City were under scrutiny.

This recent ruling significantly hinders those investigations. During a conference call with attorneys, Judge Failla expressed concern about a grand jury subpoena issued to NYU Langone, a prominent Manhattan medical system. The subpoena demanded identifying information and medical records of adolescent patients who had undergone transition care over the past six years.

The judge stated, “Those patients sought gender-affirming treatments under a reasonable assumption of absolute privacy.” She found no justifiable reason for the government to access such medical information.

She emphasized that if she did not take action, the potential consequences would be grave. The subpoena would enable the government to access and disclose deeply personal medical histories and details about the transgender status of individuals.

Judge Failla concluded, “I cannot conceive of a crime that requires such extensive disclosure. Sensitive medical information for an entire class of people over a six-year period does not outweigh the plaintiffs’ privacy rights.” Her intervention aimed to protect the private medical information and personal lives of affected individuals.
