Changes in Senate Vacancy Laws

Kentucky lawmakers passed legislation in 2024 that altered the state’s approach to Senate vacancies. The governor no longer holds the power to appoint a replacement. Instead, vacancies must be filled through a special election. This change is relevant until McConnell’s term ends in January 2027.

If a vacancy occurs before McConnell’s term concludes, the new law mandates a special election, ensuring the electorate’s voice in choosing a successor. Newsweek sought comments from McConnell’s office and the Kentucky Secretary of State regarding these developments.

Current Status of Mitch McConnell

McConnell’s health became a topic of concern after a medical emergency led to his hospitalization. Although details remain sparse, his office stated, “Senator McConnell appreciates the outpouring of support he’s receiving while he continues his recovery in the hospital.” McConnell remains active in senatorial duties while recuperating.

McConnell announced in 2025 that he would not seek reelection, with voters scheduled to select his successor in November 2026. Despite health issues, he continues his role as a U.S. senator.

Elaine Chao’s Activities in China

Attention has also turned to McConnell’s wife, Elaine Chao, due to her recent trip to China. The Daily Beast reported Chao’s participation in meetings in China days after McConnell’s medical emergency. Chinese Vice President Han Zheng met with Chao, where discussions focused on enhancing China-U.S. relations.

Implications of House Bill 622

The passing of House Bill 622 in Kentucky repealed KRS 63.200, creating a special election system for filling Senate vacancies. The governor must proclaim an election to fill any unexpired term. Administrative procedures for notices and candidacies are embedded in this new framework.

This law notably limits the governor’s capacity to appoint an interim senator, diverging from the practice followed by most other states.

Unresolved Legal Questions

While the statute mandates a special election, it raises practical questions, especially regarding vacancies in an election year. It does not address how such a vacancy would coexist with an existing Senate race on the ballot.

With McConnell’s seat already contested in 2026, the law clarifies the absence of gubernatorial appointments but leaves open questions about managing a late-term vacancy.

McConnell’s Unique Situation

Given McConnell’s announced retirement, the focus remains on handling vacancies before January 2027 under Kentucky’s new law. McConnell remains a senator, and the new legislation awaits its first application in a real Senate vacancy.

Following McConnell’s decision to step down as Senate Republican leader, Sens. John Thune, John Barrasso, and John Cornyn have emerged as potential successors, referred to as the ‘three Johns’ by several media outlets.
