ICC Chief Prosecutor Removed Amid Misconduct Allegations

The International Criminal Court (ICC) prosecutor, Karim Khan, was dismissed after an Assembly vote found him guilty of sexual misconduct. This decision marks the first time an ICC chief prosecutor has been removed while in office. The allegations involve a junior female staffer, and Khan has denied any wrongdoing.

Khan’s removal occurred after a vote by the ICC’s governing body, comprising 125 member states. Eighty-two states voted in favor of his dismissal, following disciplinary actions linked to allegations by a female aide, known only as Sarah. She disclosed during a CNN interview the lack of consent in her interactions with Khan due to power differentials.

The decision comes amid U.S. Secretary of State Marco Rubio’s campaign to dismantle the ICC, citing sovereignty concerns. Khan’s actions as a prosecutor were controversial, particularly for pursuing arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. The ICC issued these warrants in November 2024, sparking condemnation from Israel and the U.S., neither of which are ICC members.

New York politics also became embroiled in the controversy. Mayor Zohran Mamdani repeatedly referred to the ICC case against Netanyahu, vowing to arrest Netanyahu if he visited New York. However, Mamdani later acknowledged the city’s inability to enforce the warrant, appealing to the federal government to act instead.

Khan’s legal team, led by Tayab Ali of Bindmans LLP, argues the dismissal process was flawed and legally unsound. Ali criticized the handling of the case, citing the lack of opportunity for formal submissions to the Assembly. Khan plans to challenge the decision through available legal avenues.

Israeli officials, such as UN Ambassador Danny Danon, view Khan’s removal as a blow to the ICC’s credibility regarding its actions against Netanyahu. Critics argue that Khan tried to shift focus from his misconduct through politically motivated charges against Israel.

The ICC, based in The Hague, is a permanent international court responsible for prosecuting genocide, war crimes, and crimes against humanity. Despite the upheaval, the ICC has not indicated any impact on the Netanyahu and Gallant warrants, issued by judges following Khan’s requests. Efforts to contact Khan’s office for comment were unsuccessful at the time of publication.
