Arkansas Judge Dismisses Murder Charges Against Sheriff Candidate

An Arkansas judge has dismissed murder charges against Aaron Spencer, a sheriff candidate and Army veteran, who was accused of killing a man alleged to have sexually assaulted his teenage daughter. Spencer was initially charged with second-degree murder for the shooting of 67-year-old Michael Fosler in October 2024 in Lonoke County.

Special Circuit Court Judge Ralph Wilson Jr. dismissed the charges after law enforcement mishandled crucial evidence. The judge described the dismissal as “an extraordinary and extreme remedy” but necessary due to the “egregious” conduct of law enforcement. The missing dash-camera footage and SD card from Spencer’s truck were pivotal in reaching this decision, impacting Spencer’s right to a fair trial.

Prosecutors had alleged Spencer found Fosler with his daughter in Fosler’s pickup truck late at night on October 8, 2024. After reportedly forcing the truck off the road, Spencer called 911 to report the shooting. Fosler had been facing numerous sexual offense charges against Spencer’s daughter and was on bond during the incident.

Despite admitting to the shooting, Spencer pleaded not guilty to murder charges. Scheduled for trial on June 22, the case took a significant turn with the court’s dismissal of charges. Aaron Spencer emerged victorious in the Republican primary for Lonoke County sheriff, defeating the incumbent. He has publicly committed to reforming the county’s law enforcement.

Spencer has criticized the failures within the law enforcement and court systems, indicating these experiences have fueled his political aspirations. Details on how this legal outcome might affect his candidacy remain undisclosed.

The Lonoke County Prosecuting Attorney’s Office, along with the Sheriff’s Office and Spencer’s defense, have been approached for comments regarding the dismissal and future implications.
