Legislation signed by Gov. Gavin Newsom aims to direct more state funds toward arts education in local schools. However, a lawsuit remains against the Los Angeles school district, accused of misusing $77 million allocated for arts funding.
Assembly Bill 2440, spearheaded by Al Muratsuchi, seeks to guide school systems in using funds made available by Proposition 28. This proposition, passed in November 2022, allocates an amount equal to 1% of the state’s base education funding to arts education, totaling nearly $1 billion annually. These funds complement the overall education budget.
Despite the provision of these funds, many districts hesitated to spend them due to fears of violating spending regulations and facing financial penalties. The bill, supported by arts organizations, education officials, and the California Teachers Association, passed without recorded opposition until Austin Beutner, the author of Proposition 28, expressed his concerns.
Beutner worried that the bill could undermine the assurance of new arts funding reaching all schools, especially those in low-income areas. He argued it might allow districts to replace existing arts funds with Proposition 28 money, contrary to the initiative’s purpose. Beutner, alongside United Teachers Los Angeles and other influencers, opposed the bill, leading to potential litigation.
A compromise finally emerged. The bill now lets smaller schools pool funds to share an arts teacher, ensuring all schools receive additional arts instruction. It also protects districts from penalties if arts funding diminishes due to uncontrollable factors.
Meanwhile, the lawsuit against L.A. Unified continues, with Beutner accusing the district of violating Proposition 28 by reallocating existing art funding to comply superficially with the new proposition’s requirements. He claims many schools saw no real increase in arts funding from 2022-23 to 2023-24. Despite ongoing legal challenges, L.A. Unified countered by boosting its elementary arts budget by $30 million for the 2024-25 school year.
In their defense, district officials maintained they adhered to state guidance for Proposition 28 implementation, consistently asserting compliance with its mandates.
