A recent deportation incident involving a young boy and his father has sparked criticism from James Talarico, a Texas Democratic U.S. Senate candidate. Homeland Security Secretary Markwayne Mullin has responded to the situation, defending the actions of immigration authorities.

Deportation Details

Victor Martinez Nieto and his 5-year-old son, Liam Tadeo, were deported after being detained by federal immigration authorities in Austin, Texas. They were on their way to a soccer match when they were detained earlier this month. Talarico, who opposes the Trump administration’s immigration enforcement policies, criticized the deportation, highlighting that Liam was supposed to start kindergarten this week.

“ICE kidnapped Liam Tadeo on his way to a soccer game with his dad,” Talarico stated. “Liam should be in kindergarten. Instead, our government has thrown him in a prison camp hundreds of miles from home.”

Official Response to Criticism

In response, Homeland Security Secretary Mullin addressed Talarico’s remarks by explaining that the boy was deported alongside his father at the request of the father himself. Mullin stated that the Immigration and Customs Enforcement (ICE) does not separate families but offers parents the choice to remain with their children or designate another caregiver.

“Parents are asked if they want to be removed with their children or ICE will place the children with a safe person the parent designates,” wrote Mullin. “In this case, both the father and son were deported together.”

Background and Context

The father and son were detained at the Dilley Immigration Processing Center. Martínez Nieto had been arrested by immigration officers in November 2025 and deported in February of the following year. He allegedly re-entered the United States illegally, as reported by the Austin American-Statesman.

During a press conference at the Hyatt Centric Congress Avenue in Austin, James Talarico underscored the implications of such deportation practices during his Texas Senate bid. Fox News Digital has reportedly sought comments from the family’s attorney regarding the case.
