Dr. Anthony Fauci declined to respond to senators’ inquiries at a hearing regarding the origins of Covid-19 and the government’s pandemic management. He cited his Fifth Amendment rights, concerned Republicans might use his testimony against him. This unexpected move disrupted what was anticipated to be a contentious hearing, especially due to Fauci’s history of public disputes with Chairman Rand Paul.
In his opening statement to the Senate Homeland Security and Governmental Affairs Committee, Fauci mentioned Paul’s persistent calls for his prosecution and accusations against him. Fauci suggested that Paul aimed to trap him into saying something that could justify these efforts. He expressed reluctance but stated, “under the advice of my attorneys, I will invoke my right under the 5th Amendment of the Constitution to refrain from answering your questions.”

Notably, during his nearly 40-year tenure as director of the National Institute of Allergy and Infectious Diseases, Fauci testified before congressional committees over 200 times. He stressed his respect for legitimate congressional oversight. Still, despite Fauci’s refusal to respond, Paul posed multiple questions, each met with Fauci’s respectful refusal based on legal counsel.
“On the advice of counsel, I respectfully decline to answer based upon my rights under the 5th Amendment to the Constitution.”
Paul warned Fauci of repercussions for not testifying. He insisted, “It’s against the law to obstruct an investigation of Congress.” Fauci’s lawyer attempted to interject but was removed from the room by Paul’s order.

Sen. Gary Peters criticized the handling of the hearing, suggesting it could deter experts from serving the public. Sen. Richard Blumenthal refrained from questioning Fauci, defending him as someone who has saved lives worldwide. Blumenthal called the process “a perjury craft for criminal prosecution,” highlighting Fauci’s justified use of the Fifth Amendment.
Paul had previously suggested Fauci might face prosecution for lying to Congress, a claim Fauci denied. Former President Joe Biden issued a pardon for Fauci, which Paul mentioned might still face challenges.
Fauci’s attorney, David Schertler, stated that Paul’s actions necessitated Fauci’s refusal to testify. Schertler lamented the threats and harassment Fauci and his family endured, affirming Fauci’s dedication to saving lives through public health policies.
Before the hearing, Paul speculated that Americans would be disappointed if Fauci invoked his Fifth Amendment rights.
