Recent events at Six Flags Over Georgia have brought ride safety and potential liability into the spotlight. A man lost his life while riding Goliath, the park’s tallest roller coaster featuring a 200-foot initial drop. Authorities are investigating the incident to determine how a rider was ejected. Following the tragic event, Six Flags temporarily shut down nine similar roller coasters across North America, as reported by The Associated Press.
Mark Lopez-Trigo, a Florida-based personal injury attorney and founding partner of Padron & Lopez-Trigo, noted that investigators will likely explore whether the incident was isolated or indicative of broader safety equipment issues. “What led to this incident, whether it be isolated or system-wide?” questioned Lopez-Trigo. “Was it a failure in the system itself?”
He emphasized the importance of examining Goliath’s restraint system alongside maintenance and inspection records. The investigation remains in early stages, and the cause is not yet determined.
Six Flags’ decision to close similar rides could help focus liability theories, though these closures don’t necessarily signal a widespread safety problem. Goliath uses lap bars, as opposed to seat belts, reportedly pulling down over riders’ legs and waists.
Lopez-Trigo mentioned that safety-equipment failure investigations often extend beyond the moments before an accident, potentially unveiling neglect in maintenance or inspections. For the deceased’s family, civil litigation options include wrongful-death claims, with potential personal injury claims for affected guests.
While claims bring distinct legal rights and damages, the fact-finding process is pertinent for understanding the incident and targeting accountability. “Justice might mean different things to the different parties, but the path to getting that justice is probably gonna look similar,” Lopez-Trigo observed.
He noted that shutting down other roller coasters shows how much remains unknown. Discovering the cause will be crucial in assessing civil claims and addressing safety changes. “Uncovering the facts can help prevent similar incidents,” added Lopez-Trigo, highlighting the importance of a thorough investigation.
The investigation continues, with authorities yet to declare an official cause. Six Flags representatives were unavailable for comment. The Associated Press provided additional information for this report.
