The Department of Homeland Security (DHS) reports that Immigration and Customs Enforcement (ICE) lodged a detainer against Angel Israel Deras-Rivas. He is accused of leaving a 14-month-old toddler to drown in a bathtub. DHS officials requested North Carolina authorities not release Deras-Rivas, a Salvadoran national, after his arrest in Garner.
According to DHS Secretary Markwayne Mullin, current immigration policies under the Biden administration contributed to this case. Mullin stated, “This criminal illegal alien faces charges of murder and felony child abuse for allowing a toddler to drown.”
Deras-Rivas, 19, is accused of leaving his stepchild unaccompanied in a water-filled bathtub, resulting in the child’s death. Reports indicate this occurred shortly after he married the child’s mother in April. DHS identifies Deras-Rivas as having unlawfully entered the U.S. through Texas in October 2023, then released under current administration policies.
Mullin insisted, “This tragedy is a consequence of the open-border policies that permitted this criminal’s release into our country. ICE urges North Carolina officials to hold this suspect and transfer him to ICE custody for removal.”
ICE filed the detainer with the Wake County Sheriff’s Department following Deras-Rivas’s arrest. Detainers generally ask law enforcement to notify ICE prior to an individual’s release and hold the person up to 48 hours beyond the scheduled release. This allows ICE time to assume federal custody and arrange removal procedures.
