Jordan claims Smith denied under oath that he obtained lawmaker text messages, despite evidence suggesting otherwise. According to Jordan, Smith’s team accessed communications from 44 lawmakers. The focus of Jordan’s criticism is the alleged failure to filter privileged legislative communications in compliance with the Speech or Debate Clause.

This development unfolds as new revelations suggest Smith’s investigation procured communications between nearly 50 journalists and Trump administration officials. The records were obtained from text messages linked to dozens of White House phones during the federal election investigation of President Donald Trump.

Senate Judiciary Committee Chairman Chuck Grassley highlights whistleblower disclosures. Grassley questions media coverage on these revelations, criticizing the process as excessive government overreach.

Records from the National Archives, subpoenaed by Smith’s office, reveal involvement from media organizations like Fox News, CNN, CBS News, NBC News, and others. Additional records surfaced through a June 2, 2023, subpoena, covering communications from Trump’s first administration.

Grassley and Senator Ron Johnson have demanded an explanation from the Justice Department and FBI regarding screening procedures for potentially privileged materials before documents were reviewed by investigators. An email dated August 21, 2023, from assistant special counsel Thomas Windom, instructed Smith’s team to download relevant records, raising concerns about the protocols used to filter sensitive communications.

The Senate Judiciary Committee plans to explore Smith’s practices and the broader implications of the Arctic Frost investigation. The committee identified journalists involved but chose not to disclose their names due to privacy concerns.

Smith has been asked to testify before the House Judiciary Committee, and Fox News Digital is contacting Smith’s legal team for comments.
