Utah law provides extensive immunity to government entities and employees, which may complicate the wrongful death claim of Charlie Kirk’s family against the state and Utah Valley University (UVU). However, a crucial piece of evidence has emerged in legal proceedings that may help clear this obstacle, according to legal experts.
Utah Governmental Immunity Act
The Utah Governmental Immunity Act shields government entities and employees from many civil claims for damages. This makes it challenging for Kirk’s family to proceed with a civil claim. Randolph Rice, an attorney, notes that the law typically protects government parties from liability in civil suits.
“Generally speaking, they are immune from any type of civil suit, meaning money damages,” Rice explained. Nonetheless, exceptions exist.
The family has filed a notice of claim, a necessary step before a lawsuit, accusing UVU, the state of Utah, and officials of failing to ensure proper security, contributing to Kirk’s wrongful death.
Potential Key Evidence
Among the claims made, UVU Police Chief Jeffrey Long allegedly assured organizers from Turning Point USA of security measures in place, specifically addressing rooftop access concerns. This assertion could be pivotal because Kirk was fatally shot from a campus rooftop.
Rice remarked, “What they’re going to try to do is say that because they relied on the assurance, they might not be bound by the Governmental Immunity Act.”
This assurance might overcome Utah’s immunity law, allowing the family to pursue legal action against responsible parties.
Security Failures
The claim highlights a lack of physical security presence and inadequate monitoring of camera feeds, leading to the suspect moving freely and ultimately leading to Kirk’s murder.
The suspect, Tyler Robinson, who faces charges, has pleaded not guilty. He might face the death penalty if convicted for aggravated murder.
Attorney Brett Parkinson, representing Kirk’s family, stresses that the murder was preventable had the state and UVU upheld their security promises. These shortcomings profoundly affected Kirk’s family.
Skye Lazaro, another legal expert, suggests the chief’s assurance may strengthen the family’s potential lawsuit. While Utah’s immunity laws broadly protect government agencies from liability, cases often settle outside court.
