New York Governor Kathy Hochul has initiated the first-ever statewide pause on the construction of new ‘hyperscale’ data centers. This decision halts state-level environmental permits for up to a year. The goal is to allow New York time to develop a comprehensive plan to safeguard the environment, energy grid, and residents’ electric bills.
According to the governor’s office, this pause applies to data centers consuming 50 megawatts or more. The International Energy Agency (IEA) provides context, indicating that conventional data centers consume between 10 to 25 megawatts, whereas hyperscale, AI-focused centers may require 100 megawatts or more.
Governor Hochul’s move follows a recent action by the state legislature, which passed its own one-year moratorium. This proposed legislation targets hyperscale facilities defined as those with peak loads exceeding 20 megawatts. The governor is still undecided on whether to sign or veto this bill, requiring more time to collaborate with legislators.
The temporary freeze is a swift move, addressing environmental impacts and concerns about water quality and supply. Additionally, the state aims for these centers to contribute to an electric grid fund. A framework is being developed to help local authorities negotiate their agreements.
