Sen. Rand Paul Questions Fauci’s Use of Fifth Amendment

Senator Rand Paul, a Republican from Kentucky, raised questions about Dr. Anthony Fauci’s legal use of the Fifth Amendment during a congressional hearing. Fauci invoked the amendment 111 times after receiving a presidential pardon.

Paul discussed the issue on “The Will Cain Show”. He noted, “The legal question is, if you’re pardoned, can you really claim the Fifth? The Fifth Amendment is to claim immunity from self-incrimination. But if you’ve already been given immunity, you can’t self-incriminate unless you lie.”

Paul, who chairs the Senate Homeland Security and Governmental Affairs Committee, is pushing for a vote to hold Fauci in contempt of Congress. Fauci refused to answer questions about his handling of the COVID-19 pandemic and gain-of-function research.

Fauci Pleads Fifth Without Legal Justification?

Former President Joe Biden pardoned Fauci in January 2025. He stated Fauci could face “unjustified and politically motivated prosecutions” by the new Trump administration. Paul commented shortly after releasing over 1,000 pages of Fauci’s diary entries covering 2019 to 2022.

These entries reveal Fauci’s thoughts during the pandemic. He wrote about his fame and described the belief that he was “the most famous and talked about person in the country.” They also detail his views on COVID-19’s origins.

Paul shared, “We saw a constellation of what he was saying privately, and then what he was saying publicly. In January of 2020, he was saying privately, ‘We now know that the earliest cases did not come from the wet market.’ But he argued publicly for years that it did come from the wet market.”

Last Wednesday’s hearing saw Paul accuse Fauci and the National Institutes of Health (NIH) of misleading Congress. Paul claimed they destroyed records, harming public trust in COVID-19 handling.

Legal Challenges and Contempt Charges

Fauci refused to answer questions during the hearing, relying on his lawyers to avoid self-incrimination. Asked about challenging Fauci’s pardon legally, Paul said he plans to file a brief. He will argue that once pardoned, invoking the Fifth Amendment may no longer apply.

Paul expressed dissatisfaction with the hearing. He anticipated an apology from Fauci and criticized Democratic colleagues for not questioning the government’s role. He argued they prioritized defending the government over uncovering the truth.

Paul questioned if the government funded activities that led to the pandemic, which caused over a million American deaths. “They don’t seem to care about the truth,” he expressed.
