Texas criminal attorney Dick DeGuerin, with sixty years of experience in law, currently represents Lee Gilley. Gilley, 39, from Houston, is charged with murdering his pregnant wife, Christa Bauer Gilley, 38, inside their home in 2024.
Prosecutors accuse Lee Mongerson Gilley of killing Christa, who was nine months pregnant, in Houston. Reportedly, the suspect removed his ankle monitor and fled to Italy in May, just weeks before his trial was scheduled.
DeGuerin stated, “I’ve been a criminal defense lawyer for 60 years. In that time, I’ve had other clients who have skipped bond, not often, very infrequently – I’ve never had one like this.” Following his arrival in Italy, Gilley was detained by Italian authorities and has since remained in an Italian jail in Turin.
Initially, the U.S. attempted to extradite Gilley to face charges, but this was impeded by the Italian courts. The courts are unwilling to allow extradition if the death penalty is a possibility. In Texas, capital murder charges can lead to either the death penalty or life without parole.
On September 18, the Harris County prosecutors dropped the death penalty, responding to Italian judges’ demand for written guarantees before proceeding with extradition. DeGuerin stated, “Italy is asking that they commit fully that the death penalty is off the table.” He added, “We never thought that was on the table anyway, but Italy has required that.”
Further complications arise as Italian courts harbor concerns that a judge could override any agreement and still impose the death penalty. DeGuerin clarified, “The answer to that clearly is no. Only a jury can do that.” However, Italy also questions if Gilley could face a life sentence without parole if convicted, leading to potential refusal of extradition.
The U.S. is expected to provide clarification by September 30. Following this, a status conference will assess the situation regarding Italy’s position on extradition. DeGuerin has maintained, “We’ve maintained from the very beginning that he is not guilty and he did not kill his wife.” Gilley’s status conference is set for October 7.
