Trump Administration Responds to Backlash Over Immigration Policy Change

The Trump administration faced significant criticism over a recent change in immigration policy. This change could potentially compel hundreds of thousands of green card applicants to leave the U.S. The U.S. Citizenship and Immigration Services (USCIS) released guidance limiting the ‘adjustment of status’ process. This process allows immigrants applying for green cards to remain in the U.S. while awaiting approval.

Originally, the guidance indicated that those in the U.S. temporarily seeking a green card must return to their home country for application. This message raised alarm among immigrants, business groups, and immigration lawyers, fearing forced departures and potential overseas stranding due to travel restrictions implemented by the Trump administration.

In response, the Department of Homeland Security (DHS) issued a clarifying statement. The department downplayed the scope of the guidance, describing it as a restatement of existing laws and policies. DHS explained that the policy would not prevent green card applications from those who are legitimately qualified. The focus would be on ensuring some immigrants apply through the Department of State overseas rather than USCIS in the U.S.

A DHS statement reassured that skilled professionals and those benefiting U.S. national interests would continue to receive favorable discretion. Lynden Melmed, a former top USCIS lawyer, noted that the DHS statement seemed to narrow the broader implications of the initial guidance. Melmed acknowledged that USCIS officers would continue using discretion when evaluating applications.

Melmed also expressed concern that, although the rhetoric has softened, the guidance could still complicate the process for immigrants and their legal representatives. Additional evidence may be required to justify why applicants should remain in the U.S. during their green card process. Furthermore, Melmed highlighted the confusion caused by mixed messages from the administration.
