Background of the Dispute

Beachgoers might benefit from the resolution of a dispute between the California Coastal Commission and Mark Attanasio, the billionaire owner of the Milwaukee Brewers. In 2024, Attanasio’s team faced accusations of excavating sand from Broad Beach and using it for a beachfront development. This led to a lawsuit followed by an investigation by the Coastal Commission.

Findings of the Investigation

The investigation concluded that the unpermitted excavation disrupted sensitive habitats. It also determined that Attanasio’s construction project partially obstructed public access to the beach.

Resolution Agreement

The resolution proposed is unconventional. Instead of a fine, Attanasio will donate a $2-million oceanfront parcel for public use. This agreement awaits approval from the Coastal Commission.

Statements from Involved Parties

“We rarely have the opportunity to dedicate a whole parcel to the public,” says Lisa Haage, the Coastal Commission’s Chief of Enforcement. Opening pathways to Malibu’s beaches is challenging due to densely packed homes.

“This is a better way to resolve the situation than settlement money sitting in a pot somewhere,” she adds.

Details of the Property Donation

The property donation is rare in Malibu, where fines for blocking public access are common. The parcel is located 14 miles east of Broad Beach, near Big Rock Beach. Attanasio is under contract to buy the property and will donate it once the sale closes. The parcel spans 5,135 square feet with 70 feet of beach frontage, previously holding a three-unit building that burned in the Palisades fire.

Future Plans for the Parcel

The parcel will be preserved for recreational use. Specific plans will be made upon its donation to a public agency. According to Robert Moddelmog, enforcement counsel for the Coastal Commission, acquiring such lots has been historically difficult in eastern Malibu.

Additional Restoration Efforts

As part of the resolution, Attanasio agreed to return the sand and restore the beach. The excavator had damaged the rocky intertidal zone, home to various marine species.

Long-term Preservation Efforts

Preservation in Broad Beach has been a focus area over the past decade. This enclave has seen celebrities and tycoons invest millions in homes by the ocean. Sand depletion due to storms and tides led to a $31-million restoration project initiated by residents like Dustin Hoffman, Ray Romano, and Pierce Brosnan.
