Custody Case Decision Delayed for Baby with Heart Defect

A Dallas judge has postponed making a custody decision, extending a temporary restraining order by two weeks due to an ongoing legal dispute over a baby born with a rare heart defect. This baby was delivered by a surrogate.

The hearing on Tuesday provided insight into the increasing attention surrounding issues related to surrogacy and abortion. McKenna West, a nurse from Alaska who delivered the baby on August 12, has garnered support from anti-abortion groups and Republican officials. West chose to give birth in Texas, where a near-total abortion ban exists.

Parents Declare Their Love

The baby’s parents, Nausheen Gilkar and Omar Ahmed, have firmly stated their love for the baby, dismissing any contrary claims as false. Omar Ahmed and Nausheen Gilkar appeared in court in Dallas on August 25, 2026.

McKenna West relocated to Dallas two weeks prior to the birth, aiming to avert an abortion that was previously requested. She was about 20 weeks pregnant when the baby was diagnosed with hypoplastic left heart syndrome. Texas Attorney General Ken Paxton’s office has intervened in the matter, ensuring medical care for the newborn. The court’s restraining order specifies that Gilkar and Ahmed, not West, should make medical decisions for the child.

Children with this heart condition often require three surgeries, the first of which takes place within the first two weeks, as per the Cleveland Clinic.

The baby has undergone his initial surgery, according to Gilkar and Ahmed’s lawyer, and will require further surgery at four to six months of age and another between 18 months and five years. This complex heart condition can lead to lifelong challenges.

Emotional Testimonies in Court

During the court hearing, Gilkar delivered an emotional testimony, emphasizing how they are pursuing every measure to save their child.

Gilkar clarified that surrogacy wasn’t her initial preference, but was the sole option available. She shared that an agency facilitated the match with McKenna West a year ago. Gilkar claimed that West concealed her travel to Texas and restricted their access to medical records, describing West as mentally unstable.

McKenna West admitted in court to withholding medical records but expressed willingness to withdraw custody claims if the couple commits to the child’s lifesaving treatment.

Gilkar described the baby as the ‘most beautiful person’ she has seen, seeing him as the ‘love of their lives,’ and expressed sadness over his struggles.

Despite their earlier request to terminate the surrogate pregnancy in May, Gilkar assured the court of their dedication to the baby’s care, denying any intention to refuse lifesaving treatment.

Current Situation

Presently, the baby remains in critical condition, suffering from a lack of blood flow to the left side of the heart. Post-surgery complications have included difficulty breathing, choking on tubes, and requiring a blood transfusion.
