A group of 35 former federal judges has urged Judge Kathleen M. Williams to reopen a lawsuit filed by President Trump against the Internal Revenue Service (IRS). They are seeking a review of a settlement made in the case, which they believe could amount to fraud.
The lawsuit initiated by President Trump in January, involved two of his sons and the Trump family business. They claimed they were owed a substantial amount from the IRS. Recently, an agreement appeared to have been reached, leading to the dismissal of the lawsuit. However, the former judges argue this agreement might not have been conducted appropriately.
Key elements of the settlement include a $1.8 billion fund aimed at compensating Trump’s allies who say they faced ‘weaponization’ from the federal government. Additionally, the agreement provides tax benefits to Trump, his family, and their businesses.
The former judges, represented by the nonprofit Democracy Defenders and law firms Susman Godfrey and Platkin LLP, filed their motion in the Federal District Court in Miami. They assert that the settlement’s conditions, disclosed after the case’s dismissal, raise serious concerns about the transparency and fairness of the process.
“The purported ‘settlement’ that was publicly disclosed after this court dismissed this matter raises profound questions about the parties’ candor toward the court and manipulation of the judicial system, which threatens to undermine confidence in the administration of justice,” wrote the lawyers for the former judges.
The Justice Department, however, disagrees with the motion. Natalie Baldassarre, a spokeswoman, stated there is nothing unusual about the agreement and labeled the motion as frivolous.
Whether Judge Williams will reconsider the case remains undecided, as legal debates continue over the settlement’s legitimacy and fairness.
