A federal judge in Miami is set to decide whether Andrew and Tristan Tate should remain in custody while they contest extradition to the United Kingdom. The brothers face charges of rape and sex trafficking there.
Magistrate Lauren Louis will question both sides before determining if the Tates should stay in jail or be released during the extradition process, which could extend for months. The brothers have been in detention since their arrest on July 18.
The Tates are known for their controversial image online, promoting ideas of wealth and male dominance. They have denied the accusations against them.
The U.S. Attorney’s Office argues the Tates should stay detained due to the serious nature of the charges and concerns about public safety. They highlight allegations of human trafficking and violent crimes, along with witness intimidation claims in Romania.
While prosecutors view the Tates as a flight risk, defense attorneys argue the brothers’ compliance with restrictions in Romania proves otherwise. They note the Tates frequently update their location on social media.
The U.K. must provide evidence to the State Department by mid-September to back extradition. The Tates could remain in Miami’s detention center until proceedings are settled, as no hearing date has been set. For their safety, they are held in a special unit.
