Oklahoma Secretary of State Arrested for Public Intoxication

New information has emerged concerning an incident involving Oklahoma Secretary of State Benjamin Lepak. Police bodycam footage, obtained by Fox News Digital, shows Lepak’s arrest outside a McDonald’s for suspected public intoxication.

Lepak was taken into custody on Friday night in Edmond. Officers arrived following a 10:45 p.m. report of a man appearing to be drunk in public. The arrest affidavit states that police found Lepak standing near a drive-thru window, with his vehicle parked nearby. Lepak confirmed his ownership of the vehicle.

Reports indicate that Lepak displayed ‘extremely slurred speech’ and smelled of alcohol. During the encounter, he struggled to extract his identification from his wallet. His interaction with the police was not coherent, as noted in the affidavit.

Bodycam footage reveals Lepak being questioned by the police concerning his whereabouts and alcohol consumption prior to arriving at McDonald’s. Lepak mentioned attending a church gathering with other fathers earlier that evening. He admitted to having consumed a beer, though he later claimed to not have finished it.

Conflicting statements were reportedly made by Lepak about whether or not he drove to the McDonald’s. Consequently, officers arrested him on suspicion of public intoxication. A spokesperson for Lepak reiterated that he was waiting for dinner outside the restaurant and highlighted the absence of a breathalyzer test.

The incident led Oklahoma Attorney General Gentner Drummond to urge Gov. Kevin Stitt to dismiss Lepak. Drummond, echoing his dissatisfaction with Lepak’s appointment, stated that Lepak’s past arrest while found unconscious in a running vehicle should have served as a warning.

Drummond’s statement emphasized that such conduct is unbecoming of a high-ranking state official. He criticized Gov. Stitt’s decision-making, especially given the recent arrest, and called for Lepak’s immediate termination.

Lepak’s appointment as Secretary of State occurred in October 2025. His past positions include serving as the governor’s general counsel and as executive director of the State Chamber Research Foundation.
