In the years since the Supreme Court overturned Roe v. Wade, abortion remains accessible. The annual number of abortions has even risen slightly. This increase largely results from the availability of abortion pills. The Food and Drug Administration (FDA), under the Biden administration, allowed access to the abortion pill mifepristone through mail, a decision not yet reversed.
However, a lawsuit spearheaded by Louisiana threatens this accessibility. This case, which has reached the Supreme Court, has seen the Trump administration remain unusually quiet. The lawsuit resulted in a federal appeals court temporarily blocking policies that let abortion providers prescribe mifepristone through telemedicine and mail it.
The Supreme Court responded to appeals from mifepristone manufacturers by pausing the ruling. Recently, it restored telemedicine and mail access indefinitely as the case continues in lower courts.
Throughout these legal battles, President Trump, who claims strong pro-life credentials, has not publicly addressed the situation. Notably, the Justice Department, tasked with defending the FDA, chose not to file a brief to the Supreme Court. Legal experts find this silence surprising, given the direct impact of the case.
Samuel Bagenstos, a former general counsel for the Department of Health and Human Services under Biden, commented, “The lack of filing indicates the Trump administration’s challenging political position.”
