Disney filed a lawsuit against the Federal Communications Commission (FCC) on Tuesday. The aim is to block the FCC’s early proceedings for renewing broadcast licenses of ABC stations. The lawsuit claims violations of the First Amendment.
Background of the Lawsuit
In April, FCC Chairman Brendan Carr pushed for early license renewal of eight ABC-owned stations. Initially, these renewals were set for 2028 to 2031. The process was expedited due to tensions between the Trump administration and ABC late-night host Jimmy Kimmel.
ABC stations involved must prove they operate in the public interest. This is part of the FCC’s scrutiny of Disney’s diversity, equity, and inclusion (DEI) practices. ABC argues the administration retaliates due to its disapproval of ABC’s broadcasts.
“The campaign began early in this Administration and intensified over time,” Disney’s legal team stated in the complaint. “It includes demands to strip ABC of its broadcast licenses because of its speech.”
Legal Proceedings
ABC plans to seek a temporary restraining order and preliminary injunction. The lawsuit questions if the administration can use regulatory powers to punish media for unfavorable coverage. Disney argues the First Amendment prohibits such actions.
The FCC has not commented. It has also launched an investigation into ABC’s “The View.” Carr criticized the network for not airing Trump’s primetime address. Despite objections, Disney has produced over 13,000 pages of documents for the FCC’s investigations.
Disney highlights the administration’s pressure on ABC as a warning to other broadcasters. “The company bears immediate harm, but the message targets every broadcaster,” Disney noted.
ABC Stations and FCC’s Stance
ABC stations involved include KFSN-TV in Fresno, KABC-TV in Los Angeles, and several others across the U.S. The FCC spokesperson stated that broadcasters receive billions in subsidies and must serve the public interest, not political interests.
“Broadcasters must avoid DEI discrimination and adhere to political equal opportunity laws. The FCC will enforce these laws rigorously,” the spokesperson emphasized.
