Judge Considers Relaxed Constitutional Rights in Alleged Kirk Killer Trial

The Utah judge presiding over the trial of Tyler Robinson, accused of shooting conservative podcaster Charlie Kirk, suggested on Monday that constitutional rights could be approached more flexibly during preliminary proceedings.

Judge Tony Graf Jr. addressed discussions regarding the admissibility of evidence and testimony for Robinson’s trial. The accused, aged 23, requested restrictions on using hearsay to establish probable cause and sought his former roommate’s in-person testimony.

Speaking in Provo, Utah, Graf remarked that the state’s constitution permits hearsay evidence, noting that temporarily relaxing defendants’ constitutional rights during preliminary hearings is permissible. Graf emphasized that these hearings are distinct from full trials.

Robinson has yet to enter a plea following charges of aggravated murder for the September 10, 2025, killing of Kirk during a speech at Utah Valley University. Robinson’s legal representation was contacted for comment.

Defense Requests

Robinson’s defense team asked the judge to secure testimony from his former roommate, who lived with Robinson at the time of Kirk’s death, to appear in person at the preliminary hearing. Prosecutors claimed Robinson had messaged the roommate expressing contempt for Kirk, allegedly citing the conservative’s perceived hate.

The defense argued that personal testimony would allow Robinson to challenge witness credibility effectively. However, Graf denied the request, explaining the opportunity to question witnesses will arise later.

Robinson also petitioned the court to exclude hearsay evidence presented by prosecutors. According to NBC News, Graf reiterated that the upcoming proceedings are preliminary and do not determine innocence or guilt. The judge is considering potential sanctions against prosecutors for comments regarding a bullet fragment found on Kirk’s body, with a decision expected soon.

Upcoming Procedures

Robinson’s preliminary hearing is slated for July, with the full trial scheduled for a later date. The potential death penalty for Robinson, in case of conviction, remains a focal point for defense efforts aimed at opposition.
