Opening statements commenced Monday in the trial of Duane ‘Keffe D’ Davis, charged with orchestrating the murder of rapper Tupac Shakur. The trial revisits events from a Las Vegas night nearly 30 years ago. Davis, 63, faces charges of murder with a deadly weapon aimed at promoting a criminal gang. Despite pleading not guilty, he risks a life sentence if convicted.
Wearing a blue suit and tie, Davis entered the courtroom, scanning the audience before sitting next to his lawyer, Michael Sanft. The jury was sworn in and seated as Shakur’s family, including stepbrother Maurice ‘Mopreme’ Shakur, quietly occupied the front row behind prosecutors.
Chief Deputy District Attorney Binu Palal presented a photograph of a Mike Tyson fight dated ‘September 7, 1996,’ and displayed footage of Shakur’s entourage confronting Davis’ nephew, Orlando ‘Baby Lane’ Anderson. ‘On September 7, 1996, Tupac Shakur publicly participated in a humiliating beating of Duane Davis’s nephew, Orlando Anderson,’ Palal stated. ‘Two and a half hours later, Tupac was gunned down in a drive-by shooting from a white Cadillac as an act of revenge.’
Palal clarified that Davis did not directly shoot Shakur but allegedly handed the firearm to another individual in the car to execute the shooting. ‘Duane Davis did not pull the trigger, but he orchestrated the attack in retaliation for his nephew’s beating,’ Palal asserted. ‘Remarkably, these insights will be gleaned from Davis’s own admissions.’ Yet, Sanft questioned the credibility of the evidence, citing the Clark County DA’s office’s delay in charging Davis, as reported by CBS affiliate KLAS-TV. ‘No corroboration exists for any of this,’ Sanft argued, questioning, ‘What facts remain pristine after 30 years?’
The drive-by shooting, long unresolved, stirred the hip-hop community since no arrests occurred until Davis’s indictment in 2023. Shakur remains an influential cultural icon, renowned for his versatility and impact, despite his untimely death at 25. He earned six Grammy Award nominations and was inducted into the Rock & Roll Hall of Fame in 2017. Posthumously, Shakur received a star on the Hollywood Walk of Fame, a street named in his honor in Oakland, and inspired a character in the upcoming video game ‘Stranger than Heaven.’
Fans gathered early to attend the trial, with Din Malone traveling from Denver intending to stay throughout the proceedings. Malone, donning a Tupac shirt and listening to Shakur’s music, reflected, ‘As a brother and a fan, he communicated through his music.’
Over the trial’s duration, expected to span weeks, the prosecution plans to call 35 to 45 witnesses, whereas the defense anticipates only a few. Maurice Shakur told The Associated Press that attending the trial will be traumatizing for the family but remains crucial. ‘We’re standing by Pac as always,’ he expressed.
Friends and family, alongside Shakur’s supporters, congregated in Las Vegas for jury selection. Darryl Harper, a veteran music producer who collaborated with Shakur at Death Row Records, booked immediate travel upon learning the trial date. ‘He became a dear friend throughout our collaboration during his last days,’ Harper shared after arriving from Georgia.
Shakur’s cousins Kendrick Lesane and William Lesane arrived from Atlanta, determined for accountability. ‘Justice departed 30 years ago for me,’ William Lesane remarked.
Prosecutors allege Davis orchestrated the shooting from inside a white Cadillac occupied with three others, all deceased now. During investigations into the deaths of Shakur and Notorious B.I.G., Davis under agreement disclosed his role without legal repercussions. Years later, Davis published his account in a book, detailed the events, and engaged in media interviews, which reignited the inquiry.
The book and public statements, deemed crucial evidence, catalyzed the Las Vegas investigation. Prosecutor Marc DiGiacomo commented, ‘Had he not penned the book, prosecution might never have ensued.’
Sanft contends Davis co-authored ‘Compton Street Legend’ for profit rather than truth, questioning the authorship divide between Davis and author Yusuf Jah. Jah is listed among potential witnesses, having expressed disbelief in Davis fully consuming his own book.
Sanft remarked Davis remained uncharged due to perceived fabrication. Prosecutors argue the book’s sensationalism but intend to differentiate fact from fiction. Davis has denied presence the night Shakur was shot, despite his book’s narrative.
