Federal Judge Overturns Trump-Era Immigration Policies

A federal judge in Rhode Island recently annulled several immigration policies from the Trump administration. These policies had halted asylum grants and processing of immigration benefits for nationals from 39 countries.

In a detailed 135-page opinion, Judge John J. McConnell Jr. criticized the measures for holding the lives of many individuals in limbo due to their countries of birth. He argued that these policies, driven by anti-immigration sentiments, were in violation of existing immigration laws.

The affected policies, initially implemented by U.S. Citizenship and Immigration Services (U.S.C.I.S.), included a global suspension of asylum applications. This pause also applied to immigration applications from individuals in countries affected by the president’s travel ban, mainly in Africa and the Middle East. This suspension disrupted their ability to acquire green cards and other benefits.

The policies also affected lawful permanent residents, who found themselves unable to progress towards citizenship because of stalled naturalization application decisions.

This ruling is a significant setback to efforts by the Trump administration to restrain both illegal and legal immigration. It demands that the government resume normal processing and address the backlog of over a million pending applications.

James Percival, general counsel for the Homeland Security Department, criticized the decision, attributing it to what he described as “sabotage dressed in legal clothing” by political adversaries.
