In April, the NAACP filed a lawsuit against xAI, claiming the company failed to obtain an air pollution permit for its Colossus Gas Plant. This plant supports its Colossus 2 data center, which powers the AI chatbot Grok.
On Monday, the Justice Department urged the court to dismiss the case. The argument centered on the United States’ discretion regarding the enforcement of the Clean Air Act.
National Security Argument
The Trump administration emphasized the national security significance of Grok’s operation. Grok is cited as one of four AI models capable of supporting national security applications, with operations across classified networks.
Environmental Impact Allegations
The NAACP claims that xAI’s plant, comprised of 27 gas turbines, releases significant pollution. These emissions are associated with health issues such as asthma, respiratory conditions, heart problems, and certain cancers.
Furthermore, it noted that the communities surrounding the plant have a higher Black population.
