During an appearance on the “I’ve Had It” podcast, Hunter Biden, son of former President Joe Biden, sharply criticized the appointment of Merrick Garland as U.S. attorney general, calling it the “greatest mistake” of his father’s administration. Host Jennifer Welch questioned Garland’s Department of Justice (DOJ) actions, particularly for not prosecuting former President Donald Trump while investigating Hunter Biden.
Welch expressed frustration over Garland’s DOJ not prosecuting Trump and pursued Hunter Biden, describing it as “capitulation by Democrats.” Hunter Biden agreed, stating that Garland’s leadership was a significant error.
The reason that we are in the situation that we’re in right now… the buck has to stop with my dad. He was the president and he chose him,Hunter Biden explained. He suggested his father adhered strictly to constitutional norms, avoiding interference in DOJ decisions since the Nixon era.
Hunter Biden blamed Garland for failing to prosecute Trump over actions leading to the January 6 Capitol riots, which he viewed as a planned effort to undermine the 2020 election. He argued for a legitimate investigation, citing the visible actions of rioters at the Capitol.
Hunter Biden described Garland as a “moderate,” suggesting President Biden selected him to appeal to Republicans. Welch added that Garland was chosen as a favor after previous Supreme Court considerations by President Obama.

Hunter Biden, who faced DOJ investigations from 2018 during Trump’s presidency, received a pardon from his father for offenses between January 1, 2014, and December 1, 2024. The pardon came in the final weeks of Joe Biden’s presidency.
