Federal Judge Approves Arizona Border Wall Construction Amid Tribal Opposition

A federal judge in Arizona has ruled in favor of continuing border wall construction in the state, despite opposition from a Native American tribe. The Tohono O’odham Nation argued that the construction would infringe on their lands and effectively reduce their reservation’s size.

Judge Richard Leon referenced a 1907 federal proclamation allowing the use of the first 60 feet of the reservation for federal purposes. He highlighted national security and foreign policy considerations, stating, “Deference to the government is warranted.”

During a construction effort, contractors worked on replacing smaller fortifications along the Colorado River in Yuma, Arizona, as of September 10, 2019. The Tohono O’odham Nation had previously placed “no trespassing” signs in response to federal assessment visits for the construction.

The tribe’s shared border with Mexico spans approximately 62 miles. On August 8, they warned that those engaging in any construction activities would be considered trespassers and escorted off their land by law enforcement.

Judge Leon cited President Theodore Roosevelt’s 1907 proclamation, which claimed federal control over public land within 60 feet of international boundaries to prevent smuggling between the U.S. and Mexico. The Tohono reservation was officially established after the proclamation, in 1917.

This legal decision aligns with federal goals following former President Donald Trump’s administration, which recently marked 15 months with no border releases at the U.S.-Mexico border.

According to Homeland Security Secretary Markwayne Mullin’s office, daily border apprehensions have decreased by 94%, reaching the lowest levels in 30 years compared to prior administrations. Secretary Mullin stated, “President Trump’s border security agenda is restoring order and prioritizing American safety.”

Mullin emphasized that the Department of Homeland Security remains dedicated to enforcing immigration laws and ensuring the swift removal of unauthorized entrants, crediting President Trump’s leadership for achieving historical border security.
