Policy Debate Over Crime and Immigration in Fairfax County

Officials in Fairfax County, Virginia, are under scrutiny due to an increase in crimes committed by illegal immigrants. This includes serious offenses like child sexual crimes and murders. A Department of Homeland Security (DHS) report highlights that 75% of all murders in the county involve illegal aliens. This has intensified the debate over Fairfax County’s sanctuary city policies and their effect on public safety.

Recently, Oscar Evaristo Nunez, an illegal immigrant from Honduras, was taken back into custody by federal authorities. Nunez faced multiple charges related to child sex crimes and was initially arrested in August 2025. The charges involved aggravated sexual battery and non-consensual filming of a minor, according to DHS.

Despite an Immigration and Customs Enforcement (ICE) detainer, local authorities released Nunez without notifying ICE. This decision has sparked criticism from DHS, highlighting issues between the Trump administration and Virginia officials about federal immigration enforcement cooperation.

DHS Secretary Markwayne Mullin stated that Nunez, a criminal illegal alien, was arrested due to ICE efforts without support from Fairfax County’s sanctuary policy proponents. The case has fueled ongoing tensions between federal immigration authorities and local policies.

Abigail Spanberger, who became governor in January 2026, was not in office when Nunez was arrested. She has since reduced Virginia’s participation in federal immigration enforcement efforts, including terminating state agreements with ICE under the 287(g) program.

As of now, Nunez remains in ICE custody awaiting immigration proceedings. The case continues to serve as a critical point in the debate over local versus federal responsibilities in immigration enforcement.
