The Supreme Court issued significant rulings recently, impacting the authority of the president over independent agencies. In the case of Trump v. Slaughter, the court upheld the president’s right to dismiss a Federal Trade Commission commissioner. Conversely, in Trump v. Cook, the decision stated that the president cannot unilaterally fire a Federal Reserve governor. These decisions clarify limits and powers of executive authority over independent agencies.
Federal Judge’s Ruling on FEMA Workforce Cuts
A federal judge determined that the Trump administration acted unlawfully in its attempt to compel the Federal Emergency Management Agency (FEMA) to reduce its workforce by half. Judge Susan Illston found that the Department of Homeland Security (DHS) overreached by influencing FEMA’s personnel authority and ordered significant job cuts.
Despite FEMA being under DHS, legislation from 2005, following Hurricane Katrina, prevents substantial diminishment of FEMA’s functions and authority. Illston highlighted that the attempt to not renew the contracts of on-call disaster-response reservists violated this statute.
The court has set a deadline for the involved parties to submit proposals addressing outstanding relief issues by October 9.

The unions involved in the lawsuit contended that the workforce reduction plan was not only unauthorized by Congress but also jeopardized FEMA’s critical disaster-response role. They highlighted that it was directed by the then DHS Secretary Kristi Noem rather than by FEMA leadership. President Trump had previously proposed eliminating FEMA and transferring emergency preparedness responsibilities to individual states.
In response, the administration maintained that FEMA should have the autonomy to determine its staffing needs. However, the projected staffing levels appeared arbitrary, lacking a justified basis, according to the judge.

Judge Illston also criticized the use of the Signal messaging app by FEMA and DHS officials for discussing personnel cuts. The deletion of these messages raised concerns about transparency and compliance with legal regulations. The judge suggested these deleted messages could have evidenced wrongful conduct.
