A Canadian man named Mitchell Fairbarn faced conviction for animal cruelty after taking a flamingo named Peachy from its enclosure at a famous Las Vegas hotel. Prosecutors labeled the act as a malicious prank, but Fairbarn’s attorney argued it was drunken behavior without intent to harm.
Prosecutors stated Fairbarn caused harm and fear to the 27-year-old Chilean flamingo at the Flamingo Las Vegas Hotel and Casino. The defense acknowledged his regret over poor choices made while intoxicated. After five hours of jury deliberation, Fairbarn was convicted on felony and misdemeanor charges. Jurors assessed 112 exhibits and heard 14 witnesses before reaching a verdict, as reported by CBS affiliate KLAS-TV.
The actions frightened Peachy and caused physical pain, according to the prosecution.
Pending his December 1 sentencing, Fairbarn remains under house arrest. He could face up to four years in prison for the felony and an additional six months for the misdemeanor. Both Fairbarn and his attorney withheld comments post-verdict.
During the trial, Fairbarn expressed remorse, describing his actions as fueled by alcohol. He admitted to consuming 30 to 40 beers before the incident, which was caught on video showing him handling the flamingo in a hotel elevator. Peachy was later found missing feathers, with physical injuries noted by authorities.
Defense attorney Josh Tomsheck emphasized Fairbarn’s lack of harmful intent, essential to the felony charge. He characterized the defendant as drunk and making poor decisions rather than acting with malice. Prosecutor Haley Willming noted the unfortunate consequences Fairbarn faced, but stressed these resulted from his own actions.
Animal rights advocate John Waudby praised the verdict as a step toward justice for Peachy, underlining Nevada’s stance against animal cruelty. The incident underscores the broader legal and ethical imperatives surrounding the treatment of animals.
