Following a federal judge’s ruling, immigrants experienced renewed hope regarding applications that had been on hold. Although the timeframe for progress was uncertain, optimism was palpable.
Over a million applications for citizenship, green cards, work permits, and asylum were in backlog. The block had been created by policies of the Trump administration, which a judge struck down. This decision brought the possibility of resuming these applications.
Judge John J. McConnell Jr. delivered a strong opinion criticizing the policies imposed by the Trump administration. These policies had made it difficult for many immigrants to remain in the United States, effectively freezing several categories of applications.
The U.S. Citizenship and Immigration Services (USCIS) implemented policies that halted asylum applications and delayed decisions on applications by immigrants from 39 countries. Most of these countries were under a travel ban and located in Africa and the Middle East.
“When U.S.C.I.S. first enacted the policies at the center of this litigation, the agency did not simply place a hold on adjudications,” Judge McConnell stated in his opinion. “More fundamentally, the challenged policies placed the lives of countless individuals on hold — solely by virtue of their countries of birth. Over six months later, many of those individuals remain without work, without legal status, and without any meaningful ability to plan for their futures.”
The ruling represented a win for labor groups that had sued the federal government. The lawsuit was filed in March, and American Gateways, a nonprofit aiding immigrants with legal services, was among the groups involved.
