Supreme Court’s Impact on Transgender Athlete Participation

The recent ruling by the Supreme Court allows states to block trans girls and women from competing in female sports events. This decision permits 27 states to continue enforcing their bans. It does not mandate any changes for the other 23 states, but advocacy groups exert pressure on them.

Kristen Waggoner, the president of the Alliance Defending Freedom, announced on social media that states with existing policies permitting transgender participation might soon face challenges. Her organization has been instrumental in supporting laws in Idaho and West Virginia that led to the Supreme Court’s decision, actively pushing for similar measures nationwide through legislative, judicial, or voter-driven efforts.

Some Democratic-led states like Colorado and Washington are moving forward with ballot initiatives on the participation of transgender athletes. Meanwhile, the Trump administration has initiated several investigations into policies that support transgender athletes, along with Justice Department lawsuits challenging protective measures in California and Minnesota.

As the midterm elections draw near, Democratic candidates confront political pressure on this issue. A Gallup survey conducted last spring indicated that about two-thirds of adults, including 40 percent of Democrats, believe transgender athletes should compete in teams that match their birth-assigned sex.

Notably, Governor Gavin Newsom of California has voiced concerns about the fairness of transgender athlete participation. In May, a transgender high school senior in California shared state titles in high jump and triple jump, following a policy implemented the previous year.

The 27 states enforcing bans on transgender athletes all have Republican-controlled legislatures. In response to the ruling, advocates for transgender rights emphasize the necessity of reinforcing supportive policies in states governed by Democrats.
